1. Introduction
These Terms and Conditions ("Terms") govern your use of My Animal Space.
By accessing or using our Platform, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Platform.
2. Platform Description
My Animal Space is an online marketplace that connects pet owners with independent service providers offering pet-related services including but not limited to veterinary services, pet sitting, grooming, training, boarding, and other pet care services ("Services").
Important: My Animal Space acts solely as an intermediary platform. We do not provide any pet care services directly and are not responsible for the Services provided by Service Providers.
3. Definitions
- "User" means any person or entity using the Platform, including Pet Owners and Service Providers
- "Pet Owner" means a User seeking Services for their pet(s)
- "Service Provider" means an independent professional or business offering Services through the Platform
- "Services" means any pet-related services offered by Service Providers through the Platform
- "Booking" means an arrangement made through the Platform between a Pet Owner and a Service Provider
4. User Accounts
4.1. To use certain features of the Platform, you must create an account and provide accurate, current, and complete information.
4.2. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
4.3. You must be at least 18 years old to create an account and use the Platform.
4.4. You agree to notify us immediately of any unauthorized use of your account.
5. Independent Service Providers
5.1. Independent Status: All Service Providers on the Platform are independent contractors, professionals, or businesses. They are not employees, agents, or representatives of My Animal Space.
5.2. No Employment Relationship: Nothing in these Terms creates an employment, partnership, joint venture, or agency relationship between My Animal Space and any Service Provider.
5.3. Service Provider Responsibility: Service Providers are solely responsible for:
- The quality, safety, and legality of Services they provide
- Compliance with all applicable laws, regulations, and professional standards
- Obtaining and maintaining all necessary licenses, permits, insurance, and certifications
- Setting their own prices and availability
- Their own tax obligations and social security contributions
5.4. Service Providers must comply with all applicable Luxembourg and EU laws, including but not limited to those relating to professional qualifications, animal welfare, data protection, and consumer rights.
6. Platform Role and Limitations
6.1. Intermediary Only: My Animal Space provides a platform to facilitate connections between Pet Owners and Service Providers. We do not provide, supervise, or control the Services offered by Service Providers.
6.2. No Endorsement: Listings, reviews, ratings, or the presence of a Service Provider on our Platform do not constitute an endorsement, recommendation, or guarantee of their services, qualifications, or reliability.
6.3. No Vetting Obligation: While we may implement certain verification measures, we do not undertake comprehensive background checks, verify qualifications, or guarantee the accuracy of information provided by Service Providers.
6.4. We reserve the right to remove any User or listing from the Platform at our sole discretion.
7. User Responsibilities
7.1. Pet Owners must:
- Provide accurate information about their pets, including health conditions, behavioral issues, and special requirements
- Ensure their pets have required vaccinations and health documentation
- Communicate any relevant information to Service Providers before Services are provided
- Comply with payment terms agreed with Service Providers
7.2. Service Providers must:
- Provide accurate information about their qualifications, services, and pricing
- Maintain appropriate licenses and insurance
- Deliver Services with reasonable care and skill
- Comply with all applicable laws and regulations
- Treat animals humanely and in accordance with animal welfare laws
8. Bookings and Payments
8.1. Bookings are contracts formed directly between Pet Owners and Service Providers. My Animal Space is not a party to these contracts.
8.2. Payment terms, cancellation policies, and refund policies are determined by the individual Service Provider and should be agreed upon before Services are provided.
8.3. If we facilitate payments through the Platform, we act solely as a payment intermediary. We are not responsible for payment disputes between Pet Owners and Service Providers.
8.4. Service Providers are responsible for all applicable taxes on their income.
9. Limitation of Liability
9.1. No Liability for Services: My Animal Space is not responsible or liable for:
- The quality, safety, legality, or any other aspect of Services provided by Service Providers
- Any injury, illness, death, or loss suffered by pets or persons during or as a result of Services
- Any property damage occurring during or as a result of Services
- Any acts or omissions of Service Providers or Pet Owners
- Any disputes between Pet Owners and Service Providers
- Any failure by Service Providers to fulfill bookings or provide Services as described
9.2. Platform Availability: We do not guarantee that the Platform will be available at all times or free from errors, viruses, or other harmful components.
9.3. Exclusion of Damages: We shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including loss of profits, data, or goodwill.
9.4. Nothing in these Terms excludes or limits our liability for fraud, gross negligence, or any liability that cannot be excluded under Luxembourg law.
10. Indemnification
You agree to indemnify, defend, and hold harmless My Animal Space, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from:
- Your use of the Platform
- Your provision or receipt of Services
- Your violation of these Terms
- Your violation of any applicable laws or regulations
- Any dispute between you and another User
11. Insurance
11.1. Service Providers are strongly advised to maintain appropriate professional liability insurance and public liability insurance.
11.2. My Animal Space does not provide insurance coverage for Services or any incidents arising from Services.
11.3. Pet Owners are advised to maintain appropriate pet insurance.
12. Intellectual Property
12.1. All content on the Platform, including text, graphics, logos, and software, is the property of My Animal Space or its licensors and is protected by intellectual property laws.
12.2. You may not reproduce, distribute, modify, or create derivative works from any content on the Platform without our express written permission.
12.3. By posting content on the Platform, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute such content in connection with the Platform.
13. Data Protection and Privacy
Your use of the Platform is also governed by our Privacy Policy, which complies with the EU General Data Protection Regulation (GDPR) and Luxembourg data protection laws. Please review our Privacy Policy to understand how we collect, use, and protect your personal data.
14. Prohibited Conduct
You may not:
- Use the Platform for any illegal purpose or in violation of any applicable laws
- Impersonate any person or entity
- Interfere with or disrupt the Platform or servers
- Attempt to gain unauthorized access to any part of the Platform
- Post false, misleading, or fraudulent content
- Harass, abuse, or harm animals or other users
- Circumvent the Platform to arrange Services directly to avoid fees
15. Dispute Resolution
15.1. Between Users: Disputes between Pet Owners and Service Providers must be resolved directly between the parties. We may provide assistance in facilitating communication but are not obligated to do so.
15.2. Governing Law: These Terms are governed by the laws of the Grand Duchy of Luxembourg.
15.3. Jurisdiction: Any disputes arising from these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the courts of Luxembourg.
15.4. EU Online Dispute Resolution: If you are a consumer resident in the EU, you may access the EU Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr
16. Termination
16.1. You may terminate your account at any time by contacting us or using the account deletion feature.
16.2. We may suspend or terminate your account immediately if you violate these Terms or for any other reason at our sole discretion.
16.3. Upon termination, your right to use the Platform ceases immediately.
17. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on the Platform and updating the "Last Updated" date. Your continued use of the Platform after changes constitutes acceptance of the modified Terms.
18. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
19. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and My Animal Space regarding your use of the Platform.
20. Language
These Terms are provided in English. In case of any discrepancy between the English version and any translation, the English version shall prevail.
By using My Animal Space, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.
